Summary
Applicants and property owners Ricardo J. Palacios and Francis M. Burgado Santiago have submitted an Easement Vacation application for vacating and relocating the entire length of the five-foot east elevation side-yard utility/drainage easement for Lot 23 of Block B of the Skyline Hills Subdivision, and vacating and relocating the entire length of the five-foot west elevation side-yard utility/drainage easement for Lot 24 of Block B of the Skyline Hills Subdivision, for property addressed as 246 Skyline Drive. The property consists of two lots, involving approximately 0.46 acres in Section 28, Township 18 South, Range 24 East, in Lake County, Florida.
The Future Land Use Map designation for the lots is MH-HD (Manufactured Home High Density), and the lots are zoned “MH-9”, up to nine dwelling units per acre.
As part of the easement vacation application, the Utility Review Form for vacation of an easement was submitted to the local utility companies, and responses were received.
Please see comments below pertaining to whether the utility companies have utilities on site, whether they would approve the easement vacation to move forward, and whether the easement vacation would interfere with use of the easement in terms of maintenance and operation of their utility services.

The relocation of a ten-foot utility easement will be granted from the property owners to the Town of Lady Lake via an executed utility easement document that will be recorded in the public records of Lake County, Florida, establishing the new utility easement on the easterly ten-foot of Lot 24 of Block B of the Skyline Hills subdivision (see utility easement document enclosed).

A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF LADY LAKE, FLORIDA; VACATING AND RELOCATING THE ENTIRE LENGTH OF THE FIVE-FOOT EAST ELEVATION SIDE-YARD UTILITY/DRAINAGE EASEMENT FOR LOT 23 OF BLOCK B OF THE SKYLINE HILLS SUBDIVISION, AND VACATING AND RELOCATING THE ENTIRE LENGTH OF THE FIVE-FOOT WEST ELEVATION SIDE-YARD UTILITY/DRAINAGE EASEMENT FOR LOT 24 OF BLOCK B OF THE SKYLINE HILLS SUBDIVISON, FOR PROPERTY ADDRESSED AS 246 SKYLINE DRIVE (ALTERNATE KEY 3793915), WITHIN THE TOWN LIMITS OF THE TOWN OF LADY LAKE, FLORIDA.
WHEREAS, the Town of Lady Lake, holder of five foot side-yard utility/drainage easements on Lots 23 and 24 of Block B, dedicated in perpetuity and recorded on the Skyline Hills Subdivision plat, has agreed to vacate and relocate utility/drainage easements in its entirety lying within Lot 23 and Lot 24, shown in Exhibit “A,” as presented to the Town Commission of the Town of Lady Lake, on behalf of owners/applicants Ricardo J. Palacios and Francis M. Burgado Santiago; and
WHEREAS, a notice of consideration of said petition to vacate the easement has been published in the Daily Sun, a newspaper of general circulation; and
WHEREAS, the five-foot side-yard utility/drainage easements, through the dedication of the Skyline Hills Subdivision plat, is to be wholly vacated and relocated for Lots 23 and 24 of Block B to allow for the placement of a 32’ x 68’ manufactured home by the property owners upon both lots.
NOW, THEREFORE, BE IT RESOLVED that the Town Commission of the Town of Lady Lake, Florida, hereby vacates, disclaims, and quit-claims any and all interest in the easements in its entirety lying within Lots 23 and 24 of Block B of the Skyline Hills Subdivision, and releases itself of any and all maintenance obligations for the purpose of vacating said easements , and relocates the east elevation five-foot side-yard utility/drainage easement on Lot 23 and the west elevation five-foot side-yard utility/drainage easement on Lot 24 of Block B of the Skyline Hills Subdivision, to allow for the placement of a 32’ x 68’ manufactured home by the property owners upon both lots, within the town limits of the Town of Lady Lake, Florida.
This Resolution shall take effect immediately upon its adoption by the Town Commission of the Town of Lady Lake.
RESOLVED this 6th day of May, 2019, in Lady Lake, Florida, by the Lady Lake Town Commission.
