Ordinance 2022-01 — Second and Final Reading — Conditional Use Permit (CUP)— The Church at the Springs, Inc. — To allow for the placement of two RV Trailers in front of the Children's Ministry Building for a period not to exceed 12 months at 1055 Teague Trail, the northeast corner of County Road 25 and Hood Avenue, on a 1.11-acre parcel zoned light commercial, owned by Church at the Springs, Inc., and identified by Alternate Key 1449588.

Summary

On Wednesday, January 12, 2022, Town staff received a request from Ronnie Richardson with Church at the Springs Inc. to bring forth a proposal consisting of the placement of two Temporary RV Trailers to be placed at 1055 Teague Trail, identified by Alternate Key 1449588, within Lady Lake.

On February 23, 2022, the applicant was given consensus by the Town Commission to move forward with submitting the application for the CUP proposal.

On March 3, 2022, applicant, Ronnie Richardson, filed a Conditional Use Permit application for property addressed as 1055 Teague Trail, located at the northeast intersection of County Road 25 and Hood Avenue, Lot 8, 9 and the west 52 feet of 10 of Block 7 of the Conant Subdivision, referenced by alternate key 1449588, and owned by The Church at the Springs, Inc. and property known as “The Church at the Springs – Children’s Ministry Area- Villages Campus,” within the town limits of the Town of Lady Lake, Florida. The requested Conditional Use Permit from the Land Development Regulations is as follows:

Conditional Use Permit Request is pursuant to Chapter 6, Section 6-1). b). of the Land Development Regulations (LDRs).

Based upon the petition of the property owners, a Conditional Use Permit request has been requested with the following special conditions and considerations:

  1. There will be a maximum of two Temporary RV Trailers on premises
  2. The proposed two Temporary RV Trailers will be approximately 8 feet by 40 feet each
  3. The Temporary RV Trailers will follow all required Fire and Building related setbacks in association with the proposed set up
  4. The duration of the Temporary RV Trailers on premises not to exceed 12 months
  5. The Temporary RV Trailers will only be used in conjunction with current church operations during their regular church service hours for a period of 3 hours on Sunday mornings
  6. The Temporary RV Trailers will be setup as depicted by the Conceptual Plan attached as Exhibit “B” hereby attached

The subject properties lie in Section 08, Township 18 South, Range 24 East, in Lake County, Florida. Appropriate legal descriptions, a location map, and a sketch of the property have been included with the submitted application.

The Conditional Use Permit (CUP) application has been reviewed and determined to be complete satisfying the necessary criteria as required for rezoning. The application was found to meet the requirements of the Land Development Regulations (LDRs) as well as the adopted Comprehensive Plan and is ready for transmittal to the Town Commission.

Staff mailed notices to inform nine surrounding property owners within 150 feet on Monday, March 7, 2022. The property was posted on Tuesday, March 8, 2022.

PAST ACTIONS

The Technical Review Committee members individually reviewed the application and found by Thursday, March 10, 2022, that Ordinance 2022-01 was ready for transmittal to the Town Commission.

The Planning and Zoning Board does not review Conditional Use Permits (CUP)s.

At the March 21, 2022 meeting, the Town Commission voted 5-0 to approve Ordinance 2022-01 upon first reading.

AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF LADY LAKE, FLORIDA; PROVIDING FOR A NEW CONDITIONAL USE PERMIT FOR CERTAIN PROPERTY BEING APPROXIMATELY 1.11 ACRES OF LAND OWNED BY CHURCH AT THE SPRINGS, INC.; REFERENCED BY ALTERNATE KEY NUMBER 1449588, ADDRESSED AS 1055 TEAGUE TRAIL, LOTS 8 AND 9, BLOCK 7 AND THE WEST 52 FEET OF LOT 10 OF THE CONANT SUBDIVISION, LOCATED AT THE NORTHEAST CORNER OF COUNTY ROAD 25 AND HOOD AVENUE, WITHIN LAKE COUNTY, FLORIDA; PROVIDING FOR FILING OF THIS ORDINANCE; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION IN ACCORDANCE WITH LAW.

WHEREAS, on December 2, 1991, the Town of Lady Lake adopted a Comprehensive Plan (Ordinance 91-21) pursuant to the requirements of Chapter 163, Part H, Florida Statutes and Chapter 9J-5, Florida Administrative Code; and

WHEREAS, on January 23, 1992, the Florida Department of Community Affairs determined that the Town of Lady Lake Comprehensive Plan was in compliance with the requirements of Chapter 163, Part 2, Florida Statutes and Chapter 9J-5, Florida Administrative Code; and

WHEREAS, on August 15, 1994, the Town of Lady Lake adopted the Land Development Regulations (LDRs) of the Town of Lady Lake, Florida, and Official Zoning Map in accordance with the Town of Lady Lake Comprehensive Plan and the requirements of Chapter 163, Part 2, Florida Statutes; and

WHEREAS, on November 7, 1994, the Town of Lady Lake adopted Ordinance No. 94-15 annexing and rezoning 2.2 acres of property from Lake County C-2 to Lady Lake LC (Light Commercial with Special Exception Uses) which includes the 1.11-acre subject property mentioned above; and

WHEREAS, Church at the Springs, Inc. established operations at the subject property on September 1, 2012, as their “Villages Campus,” purchased the property on January 31, 2019, and since then they have made substantial improvements at the site; and

WHEREAS, Church at the Springs, Inc. is expanding the Church’s Children Ministry and has requested Conditional Use Permit Ordinance 2022-01 to be allowed for the placement of two temporary RV Trailers for immediate space needs and during the demolition and construction of a proposed building; and

NOW THEREFORE, be it ordained by the Town Commission of the Town of Lady Lake, Florida, that a New Conditional Use Permit be granted to the property known as “Church at the Springs – Children’s Ministry Area- Villages Campus,” governing property as described within Exhibit “A”, and more specifically detailed as depicted by the Conceptual Plan attached as “Exhibit B”, subject to the terms and conditions as set forth herein:

SECTION 1: Petition and Agreements:

Based upon the petition of certain landowners of property located in Lady Lake, Florida, and described in Exhibit “A” hereto, a Conditional Use Permit request has been granted with the following special conditions and considerations:

  1. There will be a maximum of two Temporary RV Trailers on premises
  2. The proposed two Temporary RV Trailers will be approximately 8 feet by 40 feet each

Said petition has been approved by the Town Commission of the Town of Lady Lake in accordance with the Town of Lady Lake Comprehensive Plan, the Land Development Regulations of the Town of Lady Lake, the Charter of the Town of Lady Lake, and the Florida Statutes.

SECTION 2: Regional, State or Federal Regulations.

This Conditional Use Permit does not exempt “The Church at the Springs – Children’s Ministry Area- Villages Campus” from compliance with all applicable regional, state, or federal regulations which may apply to the project.

SECTION 3: Review and Renewal of Conditional Use Permit.

This Conditional Use Permit shall be reviewed and renewed should the developer request additional uses or a revision of the terms contained herein.

SECTION 4: Enforcement.

This Conditional Use Permit shall be enforced through the Town of Lady Lake Code Enforcement/Special Magistrate as per the policies and procedures defined in Chapter 1, Article III, Section 1-83 of the Town of Lady Lake Land Development Regulations.

SECTION 5: Conditional Use Permit Binding Upon Successors.

This Conditional Use Permit shall inure to the benefit of and shall constitute a covenant running with the land comprising Church at the Springs, Inc., and the purpose, terms, and conditions contained herein shall be binding upon any successor and his interest hereto.

SECTION 6: Severability.

The provisions of this Ordinance are declared to be separable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses or phrases of this Ordinance, but shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.

SECTION 7: Effective Date.

This ordinance shall become effective immediately upon its passage by the Town Commission, except as limited by the provisions of Section 171.06, Florida Statutes, as said provisions pertain to newly annexed property and the final adoption of a Comprehensive Plan Amendment by the Town Commission.
