Staff recommends approval of the Water, Sewer and Reuse Utility Agreement for the Lady Lake Square Apartments.

Summary

Lady Lake Square, LLC, is the property owner of approximately 44 acres along Hwy 27/441, Fennell Boulevard and County Road 25, identified by Alternate Key Numbers 3302494, 3305124, and 1224993. The Lady Lake Square Apartment Complex is a town-approved project consisting of 288 units in nine buildings, featuring amenities to include a clubhouse and pool, maintenance building, mail kiosk, five garage buildings, dog park area, and children’s playground, providing 627 parking spaces, located at the southwest corner of County Road 25 and Griffin Avenue and having access via County Road 25, North U. S. Highway 27/441 and Rolling Acres Road. The property is zoned “HC” (Heavy Commercial) and Light Commercial (LC), and the Future Land Use is RET-Commercial General – Retail Sales and Services; which allows for the proposed apartment complex and is compatible and consistent with the Town’s Comprehensive Plan.

In order to serve the additional development with water, sewer and reuse capacity, the owner/developer is seeking to reserve 29,750 gallons per day or 119 Equivalent Residential Units (ERUs) for water, 29,750 gallons per day or 119 Equivalent Residential Units (ERUs) for Sewer, and 7,800 gallons per day or 29 Equivalent Residential Units (ERUs) for Reclaim/Reuse Water.

The Developer has agreed to utilize the Town's water, sewer, and reuse facilities to benefit the Development and to the terms and conditions hereinafter set forth in the attached Agreement, as provided by Utility (The Town). The applicant will have 30 days from the execution of this agreement to pay for the capacity.

The Lump Sum for the total ERUs allocation is $570,491.00. Should Developer fail to pay the corresponding Impact Fees allocations as provided herein, the Town, in its sole discretion, may rescind and void this Agreement in its entirety.

This agreement was reviewed by Town Attorney, Derek Schroth and Town Staff and determined correct in form for consideration and approval by the Town Commission.
