Summary
On Tuesday, July 19, 2022, applicant, Fred Schweitz, filed a Special Permit Use application on behalf of property owner Fred Schweitz #2, LLC, for an existing commercial complex known as Too Your Health Spa (V), addressed as 995 South Highway 27/441, identified by Alternate Key number 3883818, within the town limits of the Town of Lady Lake, Florida. The Special Permit Use application is in accordance to the provisions of Chapter 17, Section 17-3). e).4).
The proposed digital LED copy area will be limited to 14 square feet, which is allowed and in compliance with code.

The subject property lies in Section 28 Township 18 Range 24, Lady Lake Florida. The Heavy Commercial (HC) zoning of the subject site allows for the installation of an Electronic Message Board/Marquee Sign upon Town Commission approval; therefore, the requested permit is consistent with the directives of the Land Development Regulations and Comprehensive Plan.
Applications for Special Permit Use (SPU) must be made to the Town in accordance with the procedures established for Electronic Message Boards pursuant to Chapter 17, Section 17-3, (e). (4).
Chapter 17, Section 17-3, (e), (4) Review Criteria. When reviewing an application for a special permit use for Electronic Message Boards, the Town Commission shall consider that the applicant must adhere to the following guidelines:
Shall only be placed on approved freestanding signs.
Maximum copy area shall not exceed fourteen (14) square feet per each side.
Flashing, scintillating, beacon or running lights or movement or which gives the visual impression of such flashing, scintillation, or movement shall not be allowed.
Shall only display text. The text shall be amber-colored or similar lettering with black background.
All electronic message boards/marquee signs are required to incorporate dimming features and capabilities. These features will be reviewed concurrent with the permitting process.
A statement of adherence to the guidelines of the Electronic Message Board/Marquee Sign has been submitted indicating that the applicant will follow the standards outlined under the provisions of Town of Lady Lake Land Development Regulation, Chapter 17, Section 17-3). e). (4)., including dimming features and capabilities for the light-emitting diode (LED) sign.
Notices to inform the ten surrounding property owners within 150 feet of the subject property of the proposed Special Permit Use were notified by mail on Monday, August 1, 2022. The property was posted on Monday, August 1, 2022.

The members of the Technical Review Committee individually reviewed the application for Resolution 2022-114 and provided all comments by Thursday, August 4, 2022.
The Planning and Zoning Board does not review Special Permit Use applications.

A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF LADY LAKE, FLORIDA, WITH PROVISIONS PURSUANT TO CHAPTER 17, SECTION 17-3). e). 4). GRANTING A SPECIAL PERMIT USE FOR AN ELECTRONIC MESSAGE BOARD/MARQUEE SIGN ON AN EXISTING FREESTANDING SIGN ON PROPERTY OWNED BY FRED SCHWEITZ #2 LLC, ADDRESSED AS 995 SOUTH HIGHWAY 27/441 (ALTERNATE KEY 3883818), WITHIN THE TOWN LIMITS OF LADY LAKE, FLORIDA.
WHEREAS, FRED SCHWEITZ #2 LLC, is the owner of certain real property located in the Town of Lady Lake, Florida, more particularly described in Exhibit “A”; and
WHEREAS, the Applicant/Property Owner petitioned for a Special Permit Use under the provisions of Chapter 17, Section 17-3, e). 4). of the Town of Lady Lake Land Development Regulations, which states that any owner who desires the installation of an Electronic Message Board/Marquee Sign shall file an application for a Special Permit Use. Upon Town Commission approval, the Special Permit use will allow for the installation of an Electronic Message Board/Marquee Sign on an existing freestanding sign on property owned by FRED SCHWEITZ #2 LLC, located at 995 South Highway 27/441 (Alternate Key 3883818), within the Town limits of Lady Lake, Florida; and
WHEREAS, the Town Commission of the Town of Lady Lake held a public hearing to consider the Special Permit Use request, and having heard evidence and testimony on said request, found it to be consistent with the Lady Lake Comprehensive Plan and requirements for the Special Permit Use set forth in the Land Development Regulations of the Town of Lady Lake.
NOW, THEREFORE, BE IT RESOLVED that the Town Commission of the Town of Lady Lake, Florida, hereby grants a Special Permit Use under the provisions of Chapter 17, Section 17-3, e). 4)., of the Town of Lady Lake Land Development Regulations, which states that any owner who desires the installation of an Electronic Message Board/Marquee Sign shall file an application for a Special Permit Use. The Special Permit Use will allow for the installation of an Electronic Message Board/Marquee Sign on an existing freestanding sign erected on property owned by FRED SCHWEITZ #2 LLC, located at 995 South Highway 27/441 (Alternate Key 3883818), within the Town limits of Lady Lake, Florida.
This Resolution shall take effect immediately upon its adoption by the Town Commission of the Town of Lady Lake.
