Summary

At the Town Commission meeting on November 21, 2022, Library Director Aly Herman explained to the Commission how difficult it has been to recruit and retain volunteers to sit on the Library Advisory Board. Currently, there are only two members neither of whom can regularly attend meetings leaving us without a quorum. The members themselves feel that with the completion of the library building project and the active role played by the Friends of the Library the Board has been rendered unnecessary. At the conclusion of Ms. Herman’s presentation, the Commission consented to having staff draft an ordinance providing for the dissolution of the Library Advisory Board.

If necessary, the Lake County Library System is available to offer advice and direction but going forward, decisions related to the library will be presented directly to the Commission

Draft Ordinance 2022-22

AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF LADY LAKE, FLORIDA; REPEALING ORDINANCE 2013-14; PROVIDING FOR THE DISSOLUTION OF THE LIBRARY ADVISORY BOARD; REPEALING CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, on March 6, 1989, the Town Commission of the Town of Lady Lake, Florida, adopted Ordinance 89-06, providing for the creation of a Library Advisory Board to govern, regulate and encourage organized activities of the library system operated by the Town of Lady Lake; and

WHEREAS, subsequent ordinances were adopted on September 5, 1989 (Ordinance 89-24) and again on March 1, 1993 (Ordinance 93-01), whereby the Town Commission amended Ordinance 89-06 to modify the number of Library Advisory Board members and the composition of the Board; and

WHEREAS, on October 7, 2013, the Town Commission adopted Ordinance 2013-14 deleting and replacing Ordinance 89-06 and Ordinance 89-24 in their entirety providing for the number of members, terms of office and establishing duties for the Board; and

WHEREAS, the Town Commission has determined that the goals and objectives of the Library Advisory Board have been accomplished at a time when it is becoming increasingly more difficult to find and retain volunteers who can regularly attend meetings and maintain a quorum; and

WHEREAS, the Lake County Library Advisory Board is in place and offers support to the countywide municipalities whether or not they have their own Library Boards.

NOW THEREFORE, be it ordained by the Town Commission of the Town of Lady Lake, Florida:

Section 1.          Repeal of Ordinance 2013-14

Chapter 2, Article III, Division 3. (Sec. 2-90 through Sec. 2-93) of the Code of Ordinances of the Town of Lady Lake, Florida is hereby repealed in its entirety resulting in the dissolution of the Library Board and the members of said board are relieved of the duties and responsibilities set forth therein.

Section 2.          Severability.

If any section, sentence, clause, phrase or word of this Ordinance is for any reason held, or declared to be unconstitutional, inoperative or void, such holding or invalidity shall not affect the remaining portions of this ordinance; and it shall be construed to have been the Town Commission's intent to pass this Ordinance without such unconstitutional, invalid or inoperative part therein; and the remainder of the Ordinance, after the exclusion of such part or parts, shall be deemed and held to be valid, as if such parts had not been included herein; or if this Ordinance or any provisions thereof shall be held inapplicable to any person, groups of person, property, kind of property, circumstances or set of circumstances, such holding shall not affect the applicability thereof to any other person, property or circumstances.

Section 3.          Conflicts.

All ordinances or part of ordinances in conflict with any of the provisions of this Ordinance are hereby repealed.

Section 4.          Codification.

The provisions of this Ordinance shall be codified and become part of the Code of Ordinances, Town of Lady Lake. The sections of this Ordinance may be re-numbered or re­ lettered to accomplish such intention and the word "Ordinance", or similar words, may be changed to "Section", "Article", or other appropriate word.

Section 5.          Effective Date.

This ordinance shall become effective immediately upon adoption by the Town Commission of the Town of Lady Lake.
