Staff recommends approval of the Boulevard Oaks  Preliminary Plat Plan — Proposing a total of 160 lots, on property consisting of approximately 41.23 acres, owned by Palm Property Partners – Haymaker LLC.

Summary

Applicant, Charles Hiott of Halff Associates, Inc., has submitted a Preliminary Subdivision Plat Plan and application for approval on behalf of property owners Palm Property Partners – Haymaker LLC for the Boulevard Subdivision. Other supplementary documentation includes Warranty Deeds, Concurrency Determination Form, Property Survey, Lake County School Capacity Availability Letter and Draft Declaration of Covenants and Restrictions.

The Boulevard Oaks Subdivision proposes the construction of 160 Single-family Residential Lots. The typical lot size is proposed to be 50 feet by 112 feet with a five feet side setback from the property line, a ten-foot rear setback, and a 25-foot front setback to the local road. There are 9.07 acres devoted to stormwater management areas and open space, and 2.28 acres for park and recreation area. Overall density of the development is 3.88 dwelling units per acre. There are no wetlands on the property. All proposed roadways are public and are to be dedicated to the Town of Lady Lake. All proposed utilities are public and are to be dedicated to the Town of Lady Lake as well as the stormwater infrastructure within the right of way. The proposed stormwater retention pond and other stormwater infrastructure located in tracts shall be maintained by the developer/homeowner’s association. All easements will be maintained by the Homeowners Association. All landscaping within the right of way internal to the development will be maintained by the Homeowners Association; all common areas and retention ponds shall be maintained by the Homeowners Association.

According to the Environmental analysis, the subject development sites do not propose impact to any unique or ecologically significant area of vegetation or Wildlife Habitat. It is recommended that 90 days prior to construction and site disturbance of those lands to be developed, a physical survey for the presence or absence of Active, Inactive/Potential Occupied, or Abandoned Gopher Tortoise Borrows be completed in accordance with Florida Fish and Wildlife Conservation Commission (FWC) Gopher Tortoise Guidelines. If Active or Potentially Active Gopher Tortoise Burrows are identified within the area proposed for development, FWC regulations governing Gopher Tortoise protection, burrow excavation, relocation and mitigation are to be complied with.

The Preliminary Plat Plan was reviewed to determine compliance with the Land Development Regulations (LDRs) of the Town of Lady Lake, and Ordinance 2021-29. Attached are the following items in the packet:

Preliminary Plat Plan Review completed by the Town’s Engineer dated December 27, 2022 (Satisfied).

Preliminary Plat Plan Review completed by the Town’s Building Official, Bill Golberg, dated December 11, 2022 (Satisfied).

Preliminary Plat Plan Review completed by Town’s Fire Inspector, Kerry Barnett, dated December 13, 2022 (Satisfied).

Preliminary Plat Plan Review completed by Lady Lake Public Works Department, dated February 15, 2023 (Satisfied – all comments pertain to items addressed at the improvement plan phase).

Preliminary Plat Plan Review completed by Tetra Tech, Traffic Impact Analysis Consultant, dated. (Follow up TIA Updates will be completed on or before the Construction Plans Application Stage) comments received do not affect the proposed design of the subdivision.

Preliminary Plat Plan Review completed by Lake County Public Works Department, dated February 1, 2023 (Satisfied).

Lake County School Board Concurrency Application and Service Provider Form to be provided on or before the Construction Plat Plans Application Stage.

The property Future Land Use designation is Single-Family Medium Density (SF-MD) which permits a maximum of six dwelling units per acre. The Zoning designation is “Planned Unit Development” (PUD) established under Ordinance 2021-29 adopted on February 23, 2022. The conceptual plan (Exhibit C) of the ordinance is consistent with the proposed preliminary plat plan. The subject property located in Sections 19 and 30, Township 18 South, Range 24 East, in Lake County, Florida. The appropriate legal description, a location map, and survey of the property was included with the submitted.

The application was received on Tuesday, August 23, 2022. The Preliminary Plan meets the design requirements of the Town of Lady Lake Land Development Regulations, Chapter 8 – Subdivision and Plats, and adheres to the requirements of the Comprehensive Plan of the Town of Lady Lake. The preliminary plat plans, consisting of 31 sheets, are drawn in 24”x36” pages and have been certified by Charles C. Hiott, Professional Engineer with Halff Associates, Inc. dated November 30, 2022.

COMMENTS:

Preliminary Plat Plan Approval does not permit the construction of any improvements. The applicant must continue the process via the submittal and approval of an Improvement Plat Plan application. All regulatory agency permits must be submitted to the Town prior to the commencement of site work.

The Technical Review Committee (TRC) members individually reviewed the application finding the application complete ready to move forward to the Planning & Zoning Board.

At the March 13, 2023 meeting, the Planning and Zoning Board voted 3-0 to transmit the Boulevard Oaks Subdivision - Preliminary Plat Plan to the Town Commission with the recommendation of approval.
