Summary

Applicant, Charles Hiott of Halff Associates, Inc., submitted a Preliminary Subdivision Plat Plan and application for approval on behalf of property owner Carl A. Smith Trustee for the Lady Lake Reserve Subdivision. Other supplementary documentation includes Warranty Deeds, Concurrency Determination Form, Property Survey, Lake County School Capacity Availability Letter and Draft Declaration of Covenants, Conditions, and Restrictions.

The Lady Lake Reserve Subdivision proposes the construction of 111 lots (69 Single Family and 42 Town Homes), on property consisting of approximately 24.75 acres. There are 4.0 acres devoted to stormwater management areas and open space, and 2.82 acres for park and recreation area. Overall density of the development is 4.48 dwelling units per acre. There are no wetlands on the property. All proposed roadways are public and are to be dedicated to the Town of Lady Lake. All proposed utilities are public and are to be dedicated to the Town of Lady Lake as well as the stormwater infrastructure within the right of way. The proposed stormwater retention pond and other stormwater infrastructure located in tracts shall be maintained by the developer/homeowner’s association. All easements will be maintained by the Homeowners Association. All landscaping within the right of way internal to the development will be maintained by the Homeowners Association; all common areas and retention ponds shall be maintained by the Homeowners Association.

According to the environmental analysis, the property was surveyed for the presence of flora and fauna protected by the county, state, and federal government agencies. Targeted fauna species included the gopher tortoise and commensal species, as well as avian species. The survey resulted in the conclusion of potential sand skink presence. A sand skink survey is recommended prior to construction. Listed avian species were not observed on the subject property, including the Florida Scrub jay, and Wood stork which are in the USFWS Consultation area. Gopher tortoises and their burrows were observed on the subject site and will need to be relocated prior to construction activities on this project site. There are no historic trees on the property.

The Preliminary Plat Plan was reviewed to determine compliance with the Land Development Regulations (LDRs) of the Town of Lady Lake, and Ordinance 2022-06. Attached are the following items in the packet:

Preliminary Plat Plan Review completed by the Town’s Engineer, Steven R. Cockerham, P.E.,  dated September 20, 2023 (Satisfied).

Preliminary Plat Plan Review completed by the Town’s Building Official, Mark Brower, CBO, dated August 9, 2023 (Satisfied).

Preliminary Plat Plan Review completed by Town’s Fire Inspector, Kerry Barnett, dated September 1, 2023 (Satisfied).

Preliminary Plat Plan Review completed by Lady Lake Public Works Department, dated October 2, 2023 (Satisfied – all comments pertain to items addressed at the improvement plan phase).

Preliminary Plat Plan Review completed by Tetra Tech, Kyle Ramakers, PE, PTOE, Traffic Impact Analysis Consultant, dated July 10, 2023.

Lake County School Board Concurrency Capacity Reservation extension letter dated September 26, 2023, extending reservation until April 19, 2024.

The property Future Land Use designation is Single-Family Medium Density (SF-MD) which permits a maximum of six dwelling units per acre. The Zoning designation is “Planned Unit Development” (PUD) established under Ordinance 2022-06 adopted on July 18, 2022. The Memorandum of Agreement (Exhibit B) of the ordinance is consistent with the proposed preliminary plat plan. The subject property is located in Section 29, Township 18 South, Range 24 East, in Lake County, Florida. The appropriate legal description, a location map, and survey of the property was included with the submitted.

The application was received on Wednesday, October 12, 2022. The Preliminary Plan meets the design requirements of the Town of Lady Lake Land Development Regulations, Chapter 8 – Subdivision and Plats, and adheres to the requirements of the Comprehensive Plan of the Town of Lady Lake. The preliminary plat plans, consisting of 9 sheets, have been certified by Charles C. Hiott, Professional Engineer with Halff Associates, Inc. dated August 31, 2023.

COMMENTS:

Preliminary Plat Plan Approval does not permit the construction of any improvements. The applicant must continue the process via the submittal and approval of an Improvement Plat Plan application. All regulatory agency permits must be submitted to the Town prior to the commencement of sitework.

PUBLIC HEARINGS

The Lady Lake Reserve - Preliminary Plat Plan is tentatively scheduled to go before the Town Commission on Monday, November 6, 2023 at 6:00 p.m. for final consideration.
