Draft Minutes of the Special Commission Meeting - March 15, 2021, 5:30 p.m.

The special meeting of the Lady Lake Town Commission was held in the Commission Chambers at Lady Lake Town Hall, 409 Fennell Blvd., Lady Lake, Florida with Mayor Kussard presiding. The meeting convened at 5:53 p.m. (after waiting for a quorum as two Commissioners arrived late).

Mayor Kussard asked if anyone had any comments. There were no comments.

D. New Business

1. Conceptual Presentation to Allow the Property Assessed Clean Energy (“PACE”) Program to be Utilized as a Funding Mechanism for a 40.44 Acre Parcel Located North of Lake Ella Road and West of Highway 27/441; Previously Referenced as the Bailey Property (Thad Carroll)

Growth Management Director Thad Carroll presented the background summary for this agenda item (on file in the Clerk’s Office). He stated that Ryan Bartkus is present regarding the PACE Program as is David Springstead of Springstead Engineering.

Mr. Springstead reviewed the conceptual plan and explained the three phases to be developed, and stated they are looking at alternate funding mechanisms to move the project forward.

Kara Skelley, Vice President of Development with WP Logistic, LLC, reviewed and explained the Property Assessed Clean Energy Program (C-PACE) uses. She stated she is also a construction project manager and a PACE consultant.

Mayor Kussard asked if there were any questions or comments from the Commissioners.

Commissioner Hannan confirmed that the C-PACE program is for commercial development. He asked why the condominiums for this development are considered commercial instead of residential.

Ms. Skelley replied that the technical definition of condominiums are residential residents living inside of a commercial building.

Mayor Kussard stated that when the Commission originally approved the use of the PACE program in Lady Lake, it was for a single memory care facility, not for development of the entire property. She reiterated that the Commission is not in favor of PACE financing for any residential properties. She asked if the buyers for residential properties will be responsible for repaying the assessment for PACE financing of the development.

Ryan Bartkus with Florida Development & Finance Corporation replied that the developer of the property will pay off the PACE financing prior to the buyer purchasing a residential property. He assured the Commissioners that there will be no assessment for the residential property purchaser.

Commissioner Rietz asked if the test property using PACE programming approved by the Commission in December has been completed.

Mayor Kussard replied that the Commission approved the commercial use of PACE previously on the one property for Serenity Villas and it is still under construction, but nothing for residential property.

Mr. Bartkus and Ms. Skelley reiterated that any time a space is sold by the developer, there will be no PACE liability, lien, or assessment for the buyer.

Mr. Carroll asked if the Commission would like to direct staff to draft a site-specific resolution to allow this developer to use the C-PACE program financing to develop the property.

By a vote of 3 to 1 (Kussard), it was the consensus of the Commissioners that they were in favor of allowing the Commercial Property Assessed Clean Energy (“C-PACE”) Program to be utilized as a funding mechanism for a 40.44 acre parcel located north of Lake Ella Road and west of Highway 27/441; previously referenced as the Bailey Property, and for staff to draft a resolution in this regard.

2. Conceptual Presentation of a Proposal for Annexation of Property and the Addition of “Flex-Space” as a Permitted Use for Property Located on County Road 25 (Teague Trail) Just South of Griffin Avenue within the Town of Lady Lake; Referenced by Alternate Keys 1629586, 3539605, 2689552, and 2830476 (Thad Carroll)

Growth Management Director Thad Carroll presented the background summary for this agenda item (on file in the Clerk’s Office).

Greg Belliveau of LPG Urban Planning reviewed the new conceptual plan for this property, incorporating the use of “flex-space”.

Mayor Kussard asked if there were any questions or comments from the Commissioners.

Commissioner Hannan asked if there would be any motor vehicle repairs done at this site.

Mr. Belliveau replied that there would be no repairs, painting, or camping on this site.

Mayor Kussard noted that it made sense to annex these two properties. She stated she was not happy with the use of the term “flex space”.

Commissioner Hannan asked if there would be any modification to CR 25 in regard to development of this property.

Mr. Belliveau replied there is no plan for modification to CR 25.

It was the consensus of the Commissioners for this proposal to move forward as presented for annexation of property and the addition of “flex-space” as a permitted use for property located on County Road 25 (Teague Trail); referenced by Alternate Keys 1629586, 3539605, 2689552, and 2830476, by an all-in-favor vote of 4 to 0.
